Diversion Programs

Applications and information for diversion as an alternative to prosecution.

About Diversion

Diversion is an agreement between an offender and the County Attorney's Office under which prosecution of a criminal case is suspended for a specified period of time. If the offender successfully completes all terms of the diversion agreement, the underlying charges are dismissed. Diversion is available only at the discretion of the County Attorney and only for cases the office determines are appropriate.

Eligibility is not guaranteed. Submitting an application is not an admission of guilt and does not guarantee that diversion will be offered. Each application is reviewed individually by the County Attorney's Office.

Diversion Applications

Below are the office's current diversion applications. Download the application that applies to your case, complete it in full, and return it to the Cherokee County Attorney's Office.

Application Fees

Each application must be accompanied by a nonrefundable application fee, paid by cashier's check, money order, or firm check made payable to the Cherokee County Attorney Diversion Fee Fund. Personal checks and cash are not accepted.

These application fees are nonrefundable regardless of whether diversion is ultimately offered, and are separate from any program fees, court costs, restitution, or other amounts that may be required if a Diversion Agreement is entered.

Submitting Your Application

To be considered for participation in the Pretrial Diversion Program, the application must be completed in its entirety and submitted to the Cherokee County Attorney's Office not more than 30 days after the date of arraignment (misdemeanors) or first appearance (felonies). If Pretrial Diversion is granted, a signed Diversion Agreement must be filed not less than 14 days prior to trial (misdemeanors) or preliminary hearing (felonies). The applicant is responsible for continuing any such trial or hearing as may be necessary.
